Elon Musk Drops Lawsuit Against OpenAI CEO

Elon Musk has decided to withdraw his lawsuit against OpenAI and its CEO, Sam Altman, where he had accused the AI company of straying from its founding goal of developing AI for the benefit of humanity rather than for profit.

Musk’s legal team filed for the dismissal of the breach of contract lawsuit without prejudice in the San Francisco Superior Court on June 11, according to court documents.

This type of dismissal without prejudice means that Musk retains the option to refile the lawsuit in the future.

The decision to drop the lawsuit came just a day before a federal judge was scheduled to determine whether to dismiss the case or let it advance to the next legal stage, as earlier court documents indicated.

Musk has not made any public comments regarding his decision to discontinue the lawsuit.

Musk initially filed the lawsuit against OpenAI and Altman on February 29, 2024, alleging that the creator of ChatGPT had diverged from its foundational mission to develop its advanced language models for the “benefit of humanity, not profit.”

His concerns specifically addressed OpenAI’s partnership with Microsoft to develop artificial general intelligence (AGI) technology and its choice to release ChatGPT-4 as a closed-source project.

At that time, Musk called for OpenAI to adhere to its open-source roots and sought a court injunction to halt the commercialization of AGI technology.

Additionally, Musk raised allegations of fiduciary duty breaches and unfair business practices against OpenAI.

More recently, Musk’s grievances have extended to include OpenAI’s collaboration with Apple, which involves integrating ChatGPT into the operating systems of iPhones, iPads, and Macs.

Musk criticized Apple’s decision as an “unacceptable security violation” for Apple users, citing concerns over privacy and security due to OpenAI being a third party.

However, Apple has countered by stating that user IP addresses would be kept hidden and that OpenAI would not retain data requests.

“It’s aware of your personal data without collecting your personal data,” Apple highlighted, emphasizing the “privacy promise” of Apple Intelligence.

Last November, Musk launched a competing AI chatbot called Grok, through the company xAI, which recently secured $6 billion in funding from investors including Valor Equity Partners, Andreessen Horowitz, Sequoia Capital, and Fidelity Management & Research Company in late May.
